We have lawyers specialising in planning law within the group itself. We review the legal and planning status of your property, anticipate possible issues and coordinate the necessary documentation so the sale moves safely through to completion.

We qualify buyers, organise viewings and follow up every opportunity. We advise you throughout the negotiation to secure the best terms of sale.

Frequently asked questions about selling
- What are your fees?
- Our fees depend on the characteristics of each transaction and are set out in writing from the very start. Every dhoce client receives the same level of attention, advice and professional cover throughout the sale. Certain exclusive marketing agreements may include additional services, which are agreed with the owner beforehand.
- Do you work on an exclusive basis?
- We work both on an exclusive basis and on an open, non-exclusive basis. Exclusive agreements run for a minimum of six months and include additional services, such as the energy performance certificate, the certificate confirming there are no planning infringements, national and international promotion with paid campaigns and featured placement on the main platforms selected by dhoce, and a dedicated content and social media strategy. The terms and the services included are always set out in writing before marketing begins.
- Does the valuation have any cost or obligation?
- The initial valuation of your property has no cost and involves no commitment to instruct us. Our team analyses the property, its location, its features and the state of the market to establish a reasoned value range. From there, the owner is entirely free to decide whether to start marketing the property with dhoce.
- Which costs does the seller pay?
- The costs borne by the seller depend on the specific circumstances of the transaction and the situation of the property. The most common include the municipal capital gains tax (plusvalía municipal), any tax due on the gain obtained, the cancellation of charges or mortgages, and the costs of obtaining the documentation required for the sale. Before signing, it is advisable to review each case individually to determine which items apply.
- What is the municipal capital gains tax and who pays it?
- The plusvalía municipal is a local tax that may arise when an urban property is transferred, and it is levied on the increase in value of the land under the terms set by law. As a general rule, in a sale it is payable by the seller, although there are specific cases in which the obligation may differ. Its calculation depends, among other factors, on the cadastral value of the land, the time elapsed since the purchase and the rules applicable in each municipality.
- Do I have to pay income tax on the gain?
- Selling a property may produce a capital gain or loss, which must be declared for Spanish personal income tax (IRPF). The tax due depends, among other factors, on the acquisition value, the transfer value and the expenses that are deductible for tax purposes. Certain exemptions exist, such as reinvestment in a main residence or the sale of a main residence by people over 65, provided the legal requirements are met.
- What documents do I need in order to sell?
- The documents required depend on the characteristics of the property and the owner's situation, but they usually include the title deed, an identity document, the IBI (property tax) receipt, the energy performance certificate and documentation on any charges or mortgages. If the property belongs to a community of owners, a certificate showing that community fees are up to date will be required. Planning documents or others specific to the type of property may also be needed, so it is advisable to review each case individually before starting the sale.
- Is the energy performance certificate compulsory?
- Yes. As a general rule, a valid energy performance certificate is mandatory to sell a home. This document reports on the property's energy consumption and emissions, and it must be available throughout the marketing process. The regulations provide for some exceptions, so it is advisable to review each specific case.
- If I am not resident in Spain, how does the 3% retention work?
- When the seller of a property is not tax resident in Spain, the buyer must, as a general rule, withhold 3% of the purchase price and pay it to the Spanish Tax Agency on account of the seller's tax. This withholding is not necessarily the final amount payable, as it is later settled according to the gain obtained and the seller's specific tax situation. If the amount withheld exceeds the tax finally due, the non-resident seller can claim a refund of the difference.
Valuation and price
- How do you work out what my property is worth?
- We cross-check three things: what has actually sold in your area (not the asking prices in listings), the specific features of your property, and what is competing with it on the market right now. Size, condition, orientation, floor level and views all count. We visit the property before giving you a figure: two flats in the same building can be worth very different amounts. We give you a fully explained valuation, not a bare number.
- What if I think my home is worth more than you say?
- We show you what we base it on and we talk it through. The valuation is a recommendation, not a condition: the decision on the asking price is yours. What we do is tell you frankly what we expect to happen at each price, because finding out three months later is costly.
- Is it a good idea to start with a high price and lower it later?
- It usually goes badly, and it is worth knowing why. A property gets almost all of its viewings in the first few weeks: that is when it is seen by the buyers who have been searching for some time. If the price puts them off at that point, by the time you lower it they will already have ruled it out, and a property that has been listed for months with successive price reductions invites buyers to negotiate downwards. Starting at the right price usually ends in a higher final price.
Process and timescales
- How long does a property usually take to sell?
- It depends above all on the asking price, and then on the area and the type of property. A well-priced property moves much sooner than an identical one with an optimistic price. We would rather not give you an average that means nothing for your case: in the valuation we tell you what to expect for your particular property.
- What happens between accepting an offer and signing?
- Normally an arras contract is signed with a deposit, and from then on the deed is prepared: the documentation is checked to make sure it is in order, any charges are cancelled and the notary date is coordinated with the buyer, and with their bank if they need financing. We coordinate the legal, tax and notary side and keep you informed of what is still outstanding at each stage.
- Do I have to be present at the viewings?
- No. In fact, it usually goes better if you are not there: visitors move around more freely and ask about what really concerns them. We show the property and tell you afterwards what each person said. If you would rather be there, that is possible too.
- How do you screen interested buyers?
- Before arranging a viewing we speak to each interested party: what they are looking for, their timescale and how they are going to pay: in cash or with financing, and whether it has already been approved. That avoids a stream of viewings that lead nowhere, and you only welcome people who can genuinely buy.
Particular situations
- Can I sell if I still have a mortgage?
- Yes, it is very common. The mortgage is cancelled at the signing with part of the sale proceeds: the buyer pays the bank the outstanding amount and pays you the rest. The only thing advisable is to ask the bank for the outstanding balance in advance, and we take care of that.
- Can I sell if the property is let?
- Yes, although the tenant has to be taken into account: the tenancy agreement remains in force for the buyer and, depending on the case, the tenant may have a right of first refusal. It is a situation worth looking at in detail from the outset, because it changes which buyer to target: an investor will value it as a let asset, while someone who wants to move in will need to know when they can take possession.
- Can I sell without travelling to Spain?
- Yes. You can grant a notarial power of attorney to someone you trust so that they sign on your behalf, and this can be done from your own country, at a local notary or at the Spanish consulate. Many of our clients are foreign and this is a routine procedure: we tell you what you need and in what order.
- What happens if my property has a planning irregularity?
- The first thing is to know about it, and to know before going on the market. Many situations can be resolved or managed so that they do not block the sale; what does block it is discovering them when the buyer already has their financing under way. We have planning lawyers within the group itself: we review the legal and planning status of your property at the start, not at the end.
- What if there is undeclared building work or a licence is missing?
- It is more common than it seems: an extension, an enclosed porch, a swimming pool that is not on record. Each case has its own route: regularising it, declaring it in a particular way or selling it as it is with the buyer informed. Which is the right one depends on the details. We review it with our planning lawyers before listing and tell you what you will be facing.
Preparing the property
- Is it worth renovating before selling?
- Hardly ever a full renovation: it is difficult to recoup the investment, and it also imposes a taste that may not be the buyer's. What usually does pay off is the small, inexpensive things: painting, fixing whatever does not close or does not work, tidying up and decluttering. It takes away reasons to haggle. Before you spend anything, we tell you what is worthwhile in your particular case.
- Is home staging worth it?
- It usually is, especially if the home is empty or very personalised. An empty house looks small and cold in photos, and the photos are what decide whether someone requests a viewing. There is no need to furnish it completely: sometimes it is enough to remove things, change the lighting and take care of two or three rooms. We assess it with you when preparing the presentation of the property.
With dhoce
- Where is my property listed?
- On our website, on the national and international portals where buyers in the area search, and on our social media, where we publish our own content about the market. We also circulate it within our network of partner agents, which reaches buyers who are not looking at portals. You will see where it is listed at all times.
- Which areas do you work in?
- On the Costa del Sol (Marbella, Estepona, Manilva, Casares and the surrounding area), in Sotogrande and in Madrid. If your property is outside these areas, let us know anyway: we will tell you frankly whether we can help you or whether another option would suit you better.
